Company\'s wage ability proof. Can anyone answere my situation?

My company is a privatley owned and very restrictive about providing tax documents. Company has 400 employees and will sign a letter mentioning annual gross income and the number of employees. Currenlty I am getting $10,000 more salary what was intially mentioned in approved LC. My salary increased over the year. Is my w-2 (from 1999-2001) and current salary pay stub enough documents to show INS about the ability of my company to pay me?

I have seen many of your postings...and you are pretty mean to people.
But you look for help from others when it comes to your own case....
How would you feel if somebody answers you the way you normally do.

Anyway i cant be like you...so here is my suggestion:

1.Ability to pay is proven beyond doubt when you hold the w2 and pay stubs of the company in question that too since couple of yrs.

2.There is some thing called qarterly Payroll tax statement which every company files while paying the IRS the federal taxes for and on behalf of the employees every qtr.There is nothing secrative about this statement,since this does not show profit or loss etc...it shows the amount of payroll taxes paid for the qtr by the company.This statement should be more than enough.

Ability to pay: Employer

When a company has 100 employees or more, INS will accept a statement from the CEO or CFO on its letter head attesting that they will pay the proferred wage to the employee. No other documentation is normally needed.
 
I had similar situation

I had similar situation we send a letter from HR manager stating that we employ 2200 emplyees. You guys know that in a compnay of my size Iam not going to get a letter from my CEO or CFO. But we did attach my W2 and latest pay stubs together with a internal memo where our company CEO states that we made millions in profits. Would that be good enoguh???

Brian16, I think you can submit a new petition with all the neccessry document s attached to it, since your LC is still valid. A new I140 approves in couple of months. Much faster than either MTR or appeal.

I have the same situation here. My employer refuses to fill in Gross Annual Income and Net Annual Income items on I-140. No way to get tax returns statement from them either. I\'m concerned that if you got your case approved?

Here is my experience

I received an RFE for company financials and my lawyer responded with my paystubs.....INS denied my I140 saying paystubs were not acceptable....In INS words, it has to audited financial statements or tax returns.....

I don\'t know if you guys have received an RFE or talking about documents to be filed with I140.........If it\'s an RFE, responding with pay stubs will lead to a denial......
 
Im am not paki.. in fact we fought paki for liberation. But I dont hate either paki or indian too.

This is a forum to discuss immigration issues and not to fight with each other....Looks like the topic under discussion is not an issue any more....I thought my experience would be helpful in addressing this issue and provided them so that others don\'t get denied(believe me....It\'s so frustrating when it gets denied).....but looks like it was waste of my time......anyways....good luck...\'m bailing out

I agree, it\'s stupid but just ignore it. Anyway, I hope that your employer/attorney has supplied the audited financial statements and/or tax returns and filed an motion to reconsider or appeal. You only have 30 days to do this.

But mine was denied last year and after considering different options I re-filed my petition. Recently I got it approved.

When I responded to RFE I did not know about all these things. Ergo, just went with my lawyer by sending my paystubs and eventually got denied. If I had this information by then I would have got my GC at least a few months back. But now I still haven\'t done my FP yet and pretty much wasted one year \'cause of this stupid mistake. And because of that I ran in to various problems.

I really don\'t want others to make the same mistake and feel sorry for it later......That\'s the reason I visit other forums(though I\'m in 485 stage) once in a while to help others anyway I could.....
But it\'s painful to see people fighting about religion, country etc....It\'s your life and career, so be serious and try not to make any mistakes.....
 
milli: what about your other collegue.

You said they also appled witout tax return and got approved right? if its true, then I might have a chance. My company has over 100 emplyoees.
