Company restructuring

I applied my labor 3 years ago, it's now in backlog. Currently, our company restructuring from sole proprietorship to corporation. THe company is still the same, same management, some name, same location. If I got my labor, can I still used it for my I-140? Also, what about the tax return of the company? SInce it's just being created, is it fine for my I-140? THanks a lot in advance.
 
I mean, would they ask for the tax return from the old company, or the tax return only from the new company? Please help. Thanks in advance.
