Company name change

I had read a discussion here about the company name change between filing the original I-140 and the I-485. That caused some concern in mind as I\'m in a similar situation. Specifically my question is:

When INS asks for a new I-140 to be filed, does that mean again waiting for the over six month wait for the I-140 to be approved and then filing a new I-1485, or is it a fast-track thing that can be taken care of by responding to the RFE?

My details: EB3 INDIA, ND 7/26/1999, PD 6/26/1996, FP 5/14/2000

Appreciate your time,

Despo

No. You do not have to wait another six months for your I-140 approval. My company merged with another comapny. The company name changed after my I-140 got approved but before I could apply my I-485. I think I am the first one in the lot to receive a RFE asking me to file a new I-140 again with the new company name as the petitioner. Now I have seen at least four more cases who have received similar RFEs.
The RFE clearly says that if you have not filed an I-140 with the new company, you should do so now. And you send a complete new I-140 with the new company as the petitioner along with the original RFE letter. It will take between 14 - 60 days for your case to be approved.
The last sentence makes me hopeful. There is nothing you can do right now but wait. And if you are lucky you will not even get an RFE. I got my RFE on June 19th,2000. I mailed back the RFE on July 19th,2000. Till date, the message has not changed. I think I should hear sometime this month.
Hope this helps.

I am getting another RFE now. The message changed yesterday saying that RFE has been sent. My company changed from A to B then B to A. I tink that is the RFE for after seeing my w2 for the last three years. Do I have to start over with I 140. I was waiting for my approval after replying for an RFE ( emplyment letter, w2, paystub)

HI Akp,

Did you really do another I-140 or you provided evidence that the company\'s federal tax-id remains the same even
though the company name changed.

Could you please e-mail your response to me at freebie52@netzero.net

I didn\'t realize that you could get another RFE after you have provided the information being sought in the first RFE. Is the RFE different from an \'Intent to Deny\' that INS sends out, becuase it my understanding in such cases after they look at your resposne they either approve or deny?
