Company Name Change - I485 Pending.. Please help

Hello,

My I-485 is pending (PD Sep 2000). I have been working for Company A which was a wholly owned subsidiary of Company B. Couple of months back Company A's name was chnaged to Company C - don't know the reason. Now recently I came to know that Company C is no longer a subsidiary of Company B instead is going to become public in the next 6 months.

So my GC sponsoring Company A which was subsidiary of Company B is now a completely separate Company C which going to become public corporation in the next 6 months.

Does any of these changes have any impact on my GC Processing - do I need to do anything - If yes, then please provide me with the details about what do I need to do regarding this.

Experts please suggest.

If your I140 is approved and your I-485 has been pending for more than 6 months after 140's approval, then you are okay.
You may have to send an updated employment letter (If served with RFE).

Understand though that my opinions in the matter of immigration are worthless.

Yes my I-140 was approved a while back and also it has been more than 180 days since my I-485 has been pending. But this is applicable for AC21 if one is changing jobs. But in my case I have'nt changed jobs - it's the Company that has changed it's name etc.. as described earlier. So in this case scenario also does one has to apply for AC21 or like you said "An updated employment letter in case of an RFE"? What if I do not get an RFE and my GC gets approved - do I have to send anything to INS in that case?

My company was acquired a month ago and I was worried about these issues and posted on this forum. All the responses I got said that if your 485 is pending for more than 180 days, then you can use your EAD to work for the newly formed company. You are allowed to switch employers after your 485 is pending for more than 180 days so using your EAD would just suggest that you switched employers. Thats why you may need to send a letter to the INS about the change in employment.

if you don't have an EAD, you should apply for it. If not, you might have to file a "140 amendment", which is another 4-6 month wait...if you are happy where you're working, then this means nothing to you...your lawyer will file it and it should get approved. But if you are thinking about switching jobs then filing this amendment will hold you back I think...You should file your EAD to be safe.

It is likely that the acquition of your company is not complete yet. They may have signed the purchase agreement but for the formal acquisition to happen, it will take 2-3 months...during this time you can get your EAD. Talk to your lawyer about the options you have available.

I am currently on EAD. Nothing has changed as far as my employment/designation is concerned. The only thing is that the Company is no longer a subsidiary of parent company - instead has become a separate independent organisation and has a different name? Still confused??
 
I suggest that you get an updated emplyment letter with a writ that what was the company A is now company B. Keep the letter with you for future, should INS want to see it at a later date.

That's what I am going to do - BTW what does "writ" means??
