Company who filed H1 for you no more exists. If you find other employer let him fileH1 for you and once H1 of new company gets approved and the new employer has job for you then you can come to US. FYI at this time USCIS is after consulting companies and USCIS asks lot of documents from employer. If you find employer who is ready to file H1 for you then inform him that you were on H1 in past or provide copy of H1 approval notice and you may not be subject to Cap.I am on H-1 visa, and went out of US in July 2009, and stayed in home country due to family emergency. I had informed my employer about the same. Now that I want to return to US, contacted my employer and found out that the company has been closed. I was not aware of the closure. Could you please tell me what are the options left for me.
Let the employer file H1 for you and you get H1 approval notice from Employer after He gets from USCIS. go for new H1 stamp as new employer H1 validity may be more.
