Hi All,

My husband's 485 was filed at CSC in October 2002. We got our AP and EAD approved, but he is still working on H-1B. His company is in the process of being acquired by another company in Chicago and we might have to relocate. The company's name will be changed to the acquiring company's.

In this case, should he use EAD or reapply for H-1B under the new company's name.

At what stage will our 485 get transferred to NSC, if at all ? When we send the address change to INS ? or can our Lawyer request for the transfer.

Is it really a must to file an ammendment for I -140 regarding the company name change?

An I140 amendment is required for acquisitions. But if it is past 180 days of 485, then you can exercise AC21. If the job responsibilities are going to be the same, AC21 is the best and cheapest route. In fact your lawyer should have suggested this...
