My old employer (Company A) would want to revoke the approved I-140. I already have I-140 approved with Company B (Current Employer). My PD is based on Company A.

Since Company A is revoking my I-140 will I run into any problem for the I-140 that has been approved with Company B (Current Employer). Will my PD run into any issues?

I would appreciate if someone can provide me the above inputs.

Thanks and Regards,

-G Samy.

No, once your 140 with new employer has been approved with the old priority date you are fine and withdrawing the previously approved 140 by your old employer should not affect you.

I forgot to mention that my Company A's I-140 was based on Labor Subsitution whereas my I-140 approval for Company B is based on regular Labor.

I am assuming that irrespective of the kind of labor, the PD for the first labor can be ported to the other labor as long as the Company A's I-140 is not revoked before the time of Company B's I-140 approval. Please let me know.

The reason I am concerned is that I should not get into trouble when my I-485 comes for processing. I see lot of cases in the forum where in the Approved I-140 are being rejected during the time of I-485 processing.

Your Inputs are certainly Appreciated.
