"Commercial Driver License" and asylees? Any one with CDL (No indorsements)

Hi, everyone. I have gone to a school and got my CDL, but to my amazement after just one day my licence was taken back by DMV. I had no Hazmat endorsements nor did I intend to get one. I follow the Muslim religion and bear their names though I am from an African country. I lived here more than ten years no troubles at all.

I checked the TSA as well as FMCSA and saw nothing that bars me from getting a CDL with no Hazmat endorsement. I am looking for a person who shares this experience with me, or others who could contribute. :mad: I paid more that $6000 to my school,and I am pissed to be treated like a potential terror.

:D After all we all have our little beliefs called religions to defy our eventual mortality but just as "Timothy Mickvays" do not represent you "binladens" don't represent me either. Please positive feedbacks, thanks to all of you.

Unless there is a clearly stated policy, they cant do that. And I know they cant discriminate based on religion or national origin. You owe it to yourself and all asylees to teach these a-holes a lesson.

Did they send you a letter asking for the lic back? What reason is shown? If it was not in writing, file a FOIA request to find out what the reason was. Then contact the state attorney general's office, civil rights division, and tell them you think you were discriminated against.

What state are you in? I'd be happy to do some research for you.

My dad just renewed his CDL, although he did not have Hazmat; and he never used it. He just wanted to have it! Recently he was talking about getting his Hazmat, again just to have it!!! He never had such problems-- they sent him a letter that he had to renew his CDL, and he just went, paid like $60 and got it renewed a few weeks ago!!!
Tell us your state, and what they told you the reasons were for their retraction!!!!!

I think Anakara is valuable in thie regard, but I am little bit surprised the relationship between Hazmat and Religion. I have done little search on the term and it says it is a abbreiviation of Hazardiuos material. I don't get the connection. Why not get the endorsement if it is ganno help you out?

Getting a CDL + Hazmat requires a federal background check.. new rule after 9/11. Feel free to draw your own conclusion :)

Good point faysal, I do not see the connection between religion and hazmat license either; forgive me, I may be overlooking something!!!
 
On what grounds did they take away your CDL? The letter you received must have offered some kind of explanation. We cannot really comment without knowing the explanation!!!!!

Yes. But my recollection is that asylees are eligible for a Hazmat endorsement under DHS regulations.

Sure, but some states are still not clear on that. I did some additional research: MO clearly states that you need to have US Citizenship or green card to get even a CDL. Some other states just say legal immigration status. Since its a federal requirement, MO is obviously being overly stringent.. but who will educate them?

The federal guidelines don't say anything about Hazmat and asylum status; it just states that successful background check completion (which is required for citizens as well). To me it would mean that asylees would also qualify, but of course the check will take longer.

I politely told him that I am a word authorized legal immigrant. " I have a bad news for you Mr. amazed2006, I will keep your file open so go get me your work permit." I did not want to make a scene and I Knew no one here in Eatonton unlike Macon Ga. I quietly headed back to the school with the rest of the classmates.

Back in the school I related my ordeal to the administration and told them that I will go try my luck in Macon GA. My Gfriend came. We sailed to Macon DMV.

In the Macon office, I met with no problems with the DMV. They opened my file and upgraded my class C license to a class A (CDL). I walked out and started making calls to potential trucking companies to get a job.

Next day at about 9:30, a call!. On the other end of the line was the secretary of the CDL School. "Hi. Mr. Amazed2006, we got a letter from DMV and they are saying you have got the CDL with false documents. Please go and see them and make sure someone else drives for you. If caught while driving you might go to jail." :mad: I was very mad. used all kinds of bad word, of course not on the phone but after she hanged up, and headed with my GFriend to the DMV office.

After telling them what I was told, They seemed to be puzzled but acted professionally and took no chances on me. I got transferred to the supervisor. She asked me to sit in a secluded section of the office and asked me to wait while she makes some calls. I waited. One hour passed, and some more when she came and asked me if I wanted to wait longer or come back another time. I said " Mam I need my license so I have to wait until everything is resolved". "OK" she murmured.

After what looked like forever, she called me to her office room. She was on the phone. I could hear the dim voice of male on line. She did what that voice told her:

DMV officer: What is the school you took you driving lesson? Give us the phone number.

DMV officer: Do you have a Work permit?

Ans: I am work-authorized mam. Do you know what an asylee is?

DMV officer: No. Give me the SSN Card,

DMV officer: Do you have any immigration card that has your photo?

Ans: Well. I can get an expired card maybe.

DMV officer: Go and get it.

Ans: Here mam this is an expired EAD with 01/08/2006. But asylees don't need it. We are work authorized.

She went back to voice on the phone and came up with a directive.

DMV officer: Here is a piece of paper which has a phone# and Case #. Call this number on the 3rd of next month NO LATER OR EARLIER THAN THAT TIME DO YOU UNDERSTAND? tell them you case number after that.

Ans: Thanks mam.

:confused: I came out of the DMV office defeated, humiliated, suspected, and angry for no apparent reason that I can come up with other than what I said on my first post here. I am just waiting for things to work out by themselves!

Tell them that as you are authorized to work in the USA and provided adequate proof of that with an unrestricted SS card, you feel that you are being discriminated against because of your race or national origin.

Gosh, I am so happy I don't live in the South, with all respect, they are just on a different planet. Definitely do what Floyd recommended and don't give up. This is a clear case of ignorance and discrimination on the DMV part. May be you could sue them and get some money??:}
 
Most, if not all, DMV departments want more than a SSC. You need to submit some kind of document from the DOJ or the DHS indicating your immigration status. DMV is not the same as the I-9 form. They require you to show an immigration document.

Also try to write more concisely if you do not mind so that we can quickly get the point and reply. :)

Where did you get this info? Here is the link to DC DMV which may be one of the strictest DMVs in the country because of their proximity to the government. You don't need any proof other than your ID and an unrestricted SSC. The latter is the proof that you are legal and authorized to work in the US. Also, they don't do backgroud check at DMv, it's up to the future CDL holder employer. If you want to work for a contractor who occasionally delivers doughnuts to Pentagon, you will have to have clearance. However, if you deliver HAZMAT from one private plant to another in Utah, you may not need one. it's up to the employer. Our guy is definitely is being singled out and should inform appropriate establishments.

Why did you delete the long story you wrote about your experience? What was the problem? :confused: :confused:

But from what you wrote, the fault is on you not the DMV. Your social security card is NOT enough for you to get a DL. You need to show them proof of your asylum status (it must be a document from the USCIS, the immigration courts or the BIA).

No offense, are you the one who previously worked for an immigration court? You should be at least a semi immigration expert, then? Anybody who casually follows immigration issues knows that after 9/11 the majority of states now require DL applicants to submit immigration documents. You are not going to get a DL just showing them a social security card and any photo ID. They have to give them a document from immigration officials confirming that you are here legally and the expiration date of your stay (if any).

This will be uniform across the country when the REAL ID Act takes effect shortly.

Do not give erroneous information on this board to people--like the prior advice from you that people are completely free to visit countries of claimed persecution.

I am from Georgia and I am offended by the insults at the South.

Before accusing others of "ignorance and discrimination," you should educate yourself about the law and the rules. In Georgia (and most places) you need an IMMIGRATION DOCUMENT to prove that you are legal if you want a DL. They do not give a damn that you have a unrestricted social security card. Getting a DL and doing your I-9 paper are two completely different things; the rules are different.

As the old adage goes having a little knowledge is lethal.
