Comments needed for a case:

Scenario:

Person XYZ hopes to get his/her LC (hopefully) from Massachusetts SESA/BOSTON DOL path in start of November.

Another LC was filed in Illinois SESA/CHICAGO DOL, should arrive end of Nov.

Question:

Which one to use for concurrent filing and any advantages/disadvantages of one vis-a-vis other?

Please pour in your ideas.

----Depend on the answer to the above questions and better provide your current employer head offices and where you work at this time and who is better employer for you who is not going to lat off or you don’t have good relations and will continue your I-140 or will NOT revoke I-140 even if you have to leave at some time after filing I-140 and I-485, EAD and AP. You know both the employers and make a decision.

Here is the picture:

There is only one employer in this case.

Headoffice is in Boston and they opened another office in Chicago sometimes back. They applied for LC from both places (due to an error of HR Dept.).

XYZ is working for a client in NJ (company is a bodyshopper) and been receiving paychecks from Boston, but then should it make any difference? Also there is a bench period involved of almost 2 months.

Hope to hear your comments.
 
If company head office is in Boston, use the LC that is from MA and file I-140,I-485, EAD AP with VSC . VSC is better than NSC
 
But isn't it true that NSC is faster then VSC. I would appreciate if you can elaborate how VSC is better then NSC?

For I-485, currently NSC is processing 08/24/2001 & VSC is processing 01/15/2002.

I-140 is better in NSC though.
 
You might also look into details regarding I-140 processing time(all depends upon category EB1, EB2 etc..) because NSC is better in that area (atleast as posted in processing dates).

Above can affect AC21 rule and your eligibilty to use incase required.
 
Well my idea is 140 is all important after LC - so one should go for place where 140 is faster. One can be free of 485 issues if 140 is cleared fast. As per usnycus's post use AC-21, in case one may need it.

But the XYZ's concern lies in the fact that his headoffice being in MA will help in getting 140 easily. Besides the Chicago office started only 10 months ago and one of first 5 LCs had RFE(not of XYZ).

Now it will be a better picture to comment on.
 
Regarding RFE from IL, you need to be more specific. It could be for number of reasons and that should not bother XYZ regarding BCIS service center selection if his/her case gets approved by IL or MA.

Also, even though you are getting IL LC a month later, NSC will be better for I-140. And for overall GC processing (140-485 together), VSC looks more promising.

I think XYZ should use both LC and apply two separate I-140, one at VSC and another at NSC.
 
In given scenario, if both LC gets approved, I will apply 140/485 concurrently from VSC and only 140 from NSC.

If 140 from NSC gets approved first, you may also look in CP while VSC 485 is pending.
 
I think it is best way out. But can one file one 485 and one CP?

Does 140 applied with CP takes less time to be thru then 140 applied with 485? Or is it the same?

I meant is it that 140 stage will take less time if opted with CP rather then 485? Or is 140 not related to your choice of Cp/140?
 
I don't think I-140 processing time has anything to do with choosing CP or AOS.

Correct if I am wrong.
