Dear Friends,
My realtive has one question. He got his H1 and to it stamped in Chennai consulate and came to US,OH and worked for few weeks and his employer asked him to go to india due some problem in budget and also given time for him to change employer like h1 transfer but that time he could not find any one to transfer his h1 so he deiced to go to india. Now he has found one US job but they say you go on your old H1 to US then immediatly this new company will transfer his h1 papers.
his questions are
1. Is it okey if he can come on his old employers h1 papers
2. how to find out his h1 papers got revoked or not

Kindly advise this issue please. I am waiting and based on your reply he will decide his future. Thanks in advance...regards ram

------------------- He was on H1 of Employer and worked with Employer A in US. He can come if A has job for him. He should get letter from Employer A.
2. how to find out his h1 papers got revoked or not
-----------------H1 is filed by US employer and this time most of the employer have revoked H1 by writing to USCIS. Only employer A can inform you if A revoked or not. FYI at this time most of H1 transfer/extension are being denied or USCIS is asking lot of documents from employers.

It is not easy to get H1 extension or H1 transfer to through consulting companies .

• There are two theories for the cause of the H-1B cap number not being exhausted. Their international travels are faced by the increased challenges at the consulates and at the port of reentry. As we reported yesterday, this is an extremely challenging time for foreign professional workers and the businesses that need services of these foreign workers. We do not know when this is going to stop and how the environment can change. It will be interesting to see what long term impact it will have on the future of this country, should this continue under the environment when there is no change in the country's education system that can meet the international competitive challenges.
 
Entering on the documents of a company for which you do not plan to work is fraud. The company that has suggested this is asking that an illegal act be performed; stay clear of them. If they will violate US law, what makes you think that they will not do so again with regards to pay, etc.

Either find an ethical US employer or stay in home country.
 
Coming back to US with project with different employer

Appreicate your valuabale and timely suggestions. My friend spoke with the future employer and he explained to them and in turn they are tellin him that you are going at your own risk. At the port of entry you just say you work for the same company and find some one to help you out to save you when immigration officer call to find out about your present H1. But No one is there to help him and he also wrote letter to his H1 employer and he did not responde anything.

Finally he takes your Advise and he will wait for next chance with full H1 approval and proper placement.
