Comedy of errors - Received OATH letter with past date

I and my wife had our interviews on Mar-31-2010 at Baltimore DO. We were initially given appointments for the Oath ceremony that afternoon. While we were getting ready to leave the waiting hall and return later in the afternoon, my IO rushed out to update us that his supervisor review showed that we are not eligible for Oath as our GC 5 years is not until Apr-06-2010. He also told us that we should be getting an Oath letter in the mail after Apr-06-2010. We were glad that it did not happen at 2:30 or 2:45 PM:):)

However, over the weekend, we found a letter in the mailbox for my wife asking her to appear for the OATH ceremony on Mar-31-2010 at 3:00 PM:confused::confused:. The letter is post marked Mar-31-2010:confused: and is from National Benefits Center. It has the usual instruction at the bottom - "If you cannot make this ....... "

I am wondering if the system will flag her as a "No Show". Has anyone been through this kind of a situation before? I am thinking of an InfoPass visit to check this with the local office. It is about 1 hour drive from my place. Any other items to watch out?

Probably you should call USCIS ASAP and talk to a 2nd level officer and explain your situation. Going through infopass route may take more time.
 
Unfortunately the DO scheduled you for an oath before it found out that you weren't eligible yet since you hadn't reached 5th year anniversary. Since your DO is far away and an IO over the phone may simply request for you to wait for a new oath letter, you can send the oath letter back informing USCIS that you need to be rescheduled since you hadn't reached 5th year anniversary yet. That way you have written confirmation that you requested reschedule instead of waiting for USCIS to correct its own error.

You didn't know before the interview that you're not allowed to take the oath before your 5 year GC anniversary? If you pointed that out to the IO in the interview, he wouldn't have tried to put you in the same-day oath, and you wouldn't have to experience this comedy of errors.

Thanks a lot for your time and input. I called the 800 number and was advised to send a reply to the Balitmore DO with an explanation and request another date. The response has been mailed now.
I will update this thread on any progress.

Congratulations, glad it worked out well for you and your wife. Now between now and the oath date, stick to the speed limit, avoid DUI, no robbing banks, and don't become a communist :)

Thanks JPBoston. You are absolutely right..... No more comedies until (for that matter, even after) the Oath...

Thanks for the followup Jackolantern. It was really fast and glad it did not go through any additional hiccups...... (touchwood....).....
Hope they don't send us another letter for which we end up shopping for a time machine..... (to go to a past date)....
