Let us make a list of people who\'s Priority Date is not current but received RFE and either waiting for approval or approved. That way we can get an Idea of what\'s happening for PD not current cases. My info are as follows
EB3 INDIA, PD 07/98, RD 08/99, ND 9/99, FP 8/00 RFE, issued 12/12
RFE Replied 12/20 AVM updated 1/9 Still waiting ..

PD: Oct 01, 1996 (EB3, India)
RD: Aug 05, 1999 (I-485)
ND: Aug 25, 1999 (I-485)
RFE Issued: Sep 28, 2000 (for emp. ver. letter, pay-stubs, etc.)
Applied for I-140 redo since company had been sold & acquired.
RD: Oct 29, 2000 (amended I-140)
ND: Nov 14, 2000 (amended I-140)
AD: Dec 21, 2000 (amended I-140)
(amended I-140) Approval Notice received on Jan 04, 2001.
Second RFE for an updated Emp. Ver. Letter & last 3 pay-stubs on Jan 22 2001.
Replied on Jan 26, 2001.
Waiting on....
I-485 message says "On Jan 31st, we received your reply...."!!!!

Logically it\'s not possible but when it comes to processing logic for VSC, I wouldn\'t be surprised.. Let\'s see if there are in fact people who fall under this category..

I know couple of them posted back in December who got approved even though PD is not current ...
