Are you talking about the part time job in addition to doing the job with your GC sponsoring company?

The simple answer , I think, is NO....

If you have lost the job with your sponsoring company and looking for a parttime job on EAD or H1 transfer, the only risk is getting RFE and if your waiting time is over 180 days after filing the I-485 , you have to go for AC21 showing your new job in the same field with similar nature.

In addition to your full-time job, you CAN take up additional jobs IF you are on EAD! On H-1B, you can not, because it is tied to one specific company. But, EAD is a general employment authorization which allows you to take up as many number of jobs as possible.

Consider the case of a dependent spouse. He/She will be seen starting a job once the EAD has been received. And, nothing stops that person from taking one, two or N jobs because their EAD is not tied to a specific company.

Please note that H1B & EAD can not be used simultaneously. If you are on H1B with your sponsoring company , as soon as you use EAD for additional parttime job, your H1B is logically & legally void. That's why my simple answer was no for the first point.

For better addressing the issue here, we need to know what the situation exactly makku2003 is having....

Sorry if you misunderstood my post to mean that one can use EAD for a part-time job while working with the current company (doesn't have to be the sponsoring company) on H-1B! Once EAD is used, H-1B becomes invalid; I do agree there!

I took it for granted that the person knew that H-1B and EAD are mutually exclusive.

Given that, a person can take up "additional" jobs, IF on EAD. If the person were to continue on H-1B, while waiting on 485, additional part-time jobs could not be taken!
