My I-129 petition for H1B Transfer was submitted during Nov 2006. Subsequently Labor petition was filed on December 6, 2006 which got approved.
During February 2007 my I-140 petition was filed. Just days after that USCIS has sent RFE against my I-129 petition followed by RFE for I-539 filed for my family.
Our Attorney submitted the response against RFE of I-129 petition which reached USCIS on May 2, 2007. I am given to understand that response to RFE against I-539 can only be filed after my I-129 gets approved.
Now with the current scenario; can I file I-485 while the date remains current?
Secondly is it possible to file I-485 while the labor is approved; I-140 is in process and I-129 & I-539 petitions are still pending?
Or should I wait for my I-129 to be approved and file I-485 even before we get I-539 approval?
Please clarify.
