Hi Friends,

Mine a future employment based 485 case. I am not currently working with the sponsoring employer. But they are supporting it from the day i filed the labour till now. In between i changed 2-3 employers as part of working. Especially after filing 485 in Dec 2002 i changed the employers 2 times.

Now i am waiting for the approval to happen and then work for sponsored employer for some period of time atleast 6 months and then later negotiate with sponsored employer quit them and join as a peramanent employee.

i am eagerly waiting for the approval to come soon so that i can complete that working for some minimum time (like 6 months) quickly.

But unfortunately my case has been transferred to local washington DC district office. They have a huge delay in scheduling just for the interview. Might take around 4 months - 1 year time for scheduling the interview.

In this scenario what if i join a company who can continue the GC process from the sponsored employer. Will it effect when i was called for interview? Or what if i will be interviewed and then after that instead of joining the sponsoring employer i join another employer ?

ac 21 law states that after 180 of 485 applicaton pending, you may change employers, so as long same title and position and more o less the same salary, and dont worry green card trough employment is for future job, INS does not expect you be working for sponsoring employer..

--- YOU have NOT filed LC company A has filed LC for YOU
In between i changed 2-3 employers as part of working. Especially after filing 485 in Dec 2002 i changed the employers 2 times.
Now i am waiting for the approval to happen and then work for sponsored employer for some period of time atleast 6 months
----- do you mean to work with A?
and then later negotiate with sponsored employer quit them and join as a peramanent employee.
----- so you want to join A after I-485 approval and want to work 6 months with then then you want to move with others. if that is true you dont have problem
i am eagerly waiting for the approval to come soon so that i can complete that working for some minimum time (like 6 months) quickly.
------- who is not eagerly wating for I-485 to be cleared? all are wating who have pending I-485
But unfortunately my case has been transferred to local washington DC district office.
----- Becase you are not be with A and may be working on H1 with B or C

They have a huge delay in scheduling just for the interview. Might take around 4 months - 1 year time for scheduling the interview.

In this scenario what if i join a company who can continue the GC process from the sponsored employer.
------ if you use AC21 then better for you becase you will have recent 3 pay stubs from the new employer who is giving you future permanent job offer( at the time of Interview they will ask the recent 3 pay stubs
Will it effect when i was called for interview?
-----No, just go with new employer letter at the time of interview and request that you would like to use AC21 and provide the new employer letter and recent pay stubs
Or what if i will be interviewed and then after that instead of joining the sponsoring employer i join another employer ?
----- I did not understand your question. do you mean that if you are approved for A or New employer(if you use AC21) you should work minimum 6 months with employer whose job offer letter is base of your I-485 approval. if you dont work for the employer A or new employer( whose letter you use for AC21) you may face problems at the time of citizenship or when you renew GC

ginnu,perico,

Thanks for considering to responde back to my question.

Since my sponsoring employer's company not a very big company its difficult finding projects with them always.

Initially when filed 485 or after completing 180 days after filing 485 i am not comfortable to switch the 485 process to a new employer because of the uncertainity of job market situations. It will be a problem if i loose a job with new employer and then i have to be responsible in carrying it over to next employer. I thought its better to keep the process with the sponsoring employer till the last possible time.

Recently my case has been moved to local office for interview. Case got transferred on 23rd september. After talking to local office immigration people they are giving an rough estimation of 4-6 months for scheduling the interview. I am not sure whether that could be the reason why they transferred my case to local office. I cannot generalize it because one of my friend who was not working with the sponsoring employer recently got approved too who applied close to my dates from same service center.

Now iam thinking in the scenario that why would i have to work with that small employer after immediately getting the GC. Why not i join with another employer kind of similar job (may not be the same title as given in labour). Is it a mandatory that the title should match exactly? Lot of companies won't give the same designation like Sr. Software Engineer, Software Engineer I , Systems Analyst, Programmer Analyst, Programmer etc. Is it a recommendable thing to do changing the job before interview? Or will this would impact my Gc process in very last leg?

If i achieve to find an opportunity before my interview what kind of stuff do i need to do for the interview? What kind of documentation do i need to take new company? I know pay stubs with new company, employment letter supporting the GC , tax returns of the new company, AC21 letter need to be given by the attorney?

What would you guys advice me with experience? Is it best to take the opportunity or since i am in the last way just hang around with the old sponsoring employer after GC for about 6 months (no clear around how long to work with an employer who sponsors the GC right) and then change to a peramanent opportunity with another employer?

I heard people saying in the forums if change the job immediately after getting GC with sponsoring employer there will issues with Naturalization or renewal of GC? How far is that true? How many months working would solve this issue?

I am kind of looking for the answer from you guys?
