Clarification on the 90-day advance rule?

Hello,

I needed to clarify on a doubt I had regrading applying for naturalization 90 days in advance. If someone could clarify, it would be much appreciated!

Case:
Greencard obtained: 9/2001
Married to a USC spouse: 6/2003
Applying for N-400 thru' the same US spouse: 1/2012

Considering the above information, does the 90 day advance rule also apply in this particular case, so that I could apply in 10/11 instead of 1/12?​

What's your real question? What is the real issue? Something of major importance is missing from your post or your are of exceedingly low IQ.

The 90-day headstart is for people who haven't completed 5 years (or 3 years, in the case of marriage to a USC) of continuous residence. You're already long past that, so what is your concern?

And why do you want to apply based on marriage to a USC, when you've had a green card for much more than 5 years which qualifies you for the simpler 5 year option?

In 2007 & 2008, I was out of the country for more than 6 months and hence am eligible to apply again by Jan '12. The question in mind was if I could apply in Oct '11, with the 90-day advance rule?

Is this a valid inquiry or maybe I am missing something in my understanding?

when you stayed out of country for more than 6 months, you would fall under 4 year + 1 day rule from the date of your last return from 6 months or longer trip. (90 rule is not applicable in that case).
