Clarification about status

Hi people..
I recently became a US citizen and applied AOS for my wife around the last week of November. She is on a valid I-94 with F1 visa. Out here in dallas, looks like people get the receipts frm the INS in like 2 months. We do have the certified mail return receipt though.
1) Does my wife need to maintain her F1 status as long as we dont get any confirmation letter from the INS or is she okay to abandon her F1 status since her AOS is being processed.

Could some1 pls clarify this for me? Thanks in advance.

Can some1 please solve my query in this case?
Does a person whose AOS has already been filed (as a spouse of a US citizen) need to maintain his/her status till the INS receipt or the EAD comes through?
IS there a post regarding this matter some1 can point me to?

Wish you a very Happy New Year and thanks for the reply. Actually in my case, I've recently become a US citizen and filed AOS for my wife who is on a student visa (F1). We still havent got a receipt from the USCIS and we were totally confused if my wife needs to go to school for the ensuing Spring Semester (2004) to maintain her status or not.
Can you please guide us on this? Thanks in advance.
 
She can choose to maintain her FI status or till you hear something, but either way she is fine so long as when you applied for the AOS she had a valid I-94 you guys have nothing to worry about. You did a smart thing by mailing it certified because you have proof that INS has received it. I hope you made a compy of everything you sent them. If you didn't from now on, always keep a copy just in case. Good luck
 
Thanks Vidash for the reply. Yep, we do have the certified mail receipt and also the copy of all the documents which we sent, so that should be no problem.
I just wanted to confirm that since that now I've applied AOS for my wife, she is not required to maintain her own...Do u think we further need to clarify this with an immigration attorney?

F1 while waiting for I-130 approval

Hello,

A valid visa is good till you get I-130 approved. Finger prints come within 3 months from applying. Then I-130 may take 6 to 12 months. I got it in about 11 months in Jersey. After getting I-130 approved you can get EAD and Travel Parole etc. I-485 may take another 6 months.

Thanks people for all your responses..We finally got the payment receipt from the INS only last evening. So I guess now we should wait for the EAD and AP to come through.
It took us almost 1 month from the date we applied to receive the payment receipt out here in dallas for fyi..
