Claim to be US Citizen in error

Guys,

My cousin had applied for a private student loan in 2005 and inadvertently the agent who was processing her loan had check marked the US Citizen box on the loan application, which she signed without checking the application.

Please note she has not claimed to be a US Citizen on any of her federal or state student loans or any other legal document.

She will be filing her N400 next week and is looking for advise, should she write down a statement on the error that has occurred with the N400 application?

Any advise would be helpful.

The agent made the mistake assuming she is a USC and she didn't noticed it and signed, no harm in disclosing it with explanation. Should not be a big deal at all.
It would have been a bit complicated had that been a Grant or a scholarship only meant to be for a USC but it was a loan and she was probably eligible for it either way.

If she does submit the statement, following questions may come up and complicate the issue: 1. Since the loan was applied for in 2005, why didnt she ever think of making the correction? Or informing the agent about the error? 2. How did she find out that there was infact an error on the form? 3. The person responsible for filling out the form, always asks the immigration status of the applicant. Did the agent ask her? or before signing the application, was she told to go thru the application before signing? As you can see, no one is going to hold the agent responsible for any kind of error. Your cousin will be held accounable for this mistake unless she comes up with a solid reason. Although student loans/grants may not be a point of consideration, but the way these are acquired may be. Please use your best judgement before sending in the N-400.
