Hi All, I have the following question.

1. Obtained GC on Jan 01 2005 ( This is the date on GC)

Can I apply for citizenship now? Some say I could apply before 6 months before I reach the 5 years of lawful GC Holder.( My spouse is not a citizen)

2. My son would be 18 years old on 12/09/09 - If I have to wait till I complete 5 years to apply , Does my son has to apply on his own or Is he still eligible to get the automatic citizenship through parents?

Thanks

You can apply 90 business days before Jan 01, 2010, I've never heard of 6 months I don't think thats accurate. I think you are in time to apply now but I don't think is going to be done before your son's birthday.

No, it's 90 day calendar days before the 5-year GC anniversary. Which in this case would be Oct. 3, 2009.

However, that GC date could be erroneous... 1/1/2005? I've never heard of them approving anything, GC or EAD or AP or otherwise, on January 1st.

Although you can apply 90 days before completing the 5 years, you cannot take the oath until the full 5 years are done, so there is no way you can become a citizen before your son's 18th birthday. He will have to apply on his own, which he can do as soon as he turns 18, assuming he is also within 90 days of completing his 5 years as a PR on his 18th birthday.

I never heard that is 90 days BUSINESS DAYS rules. It is hard to calculate business days. I think calender days is good enough.

Thanks for all your answers. I will apply on October 3rd. Will keep you all posted. As per my son, I think he has no choice and he has to apply on his own.

One more question, Is there a big queue for getting the citizenship. Roughly how long does it take for the whole process. I live in NJ so I need to apply to TX center.

Thanks again and good luck
