Citizenship interview passed... then nothing

On 04/27/2005, I passed my Citizenship interview in San Francisco USCIS office, however officer told me that "there was no FBI approval yet". He gave me N-652 where "B) A decision cannot be made about your application" was checked. He said waiting could take "two months but sometimes much longer".

On the bottom of N-652 I was advised about my right to request a hearing before the US district court if USCIS had not made a determination within 120 days of the date of my examination.

In late July, I received USCIS letter stating that my N-400 application "is still pending for completion of all necessary background checks" and thanking me "for your cooperation and patience". The letter was signed by District Director.

What should I do now? Should I try contacting FBI? If yes, what's best way of doing this? My fingeprinting was done in January 2005. Priority date 12/17/2004.

Or should I try InfoPass? Any other actions?

Please advise.

your 120days from your initial interview day should have been passed. from various posts, people are trying to file a law suite against USCIS regarding they have not been able to make a decision within 120 days. may be you can check out the other posts for more comments.
 
I have the same issue

I have the same issue as yours. I passed the interview on 6/20/05 and wait for the name check since then. I submitted the FOIPA on Oct. 5 and got the "no records" answer from the FBI. Can anybody tell me what shall I do next? Thanks a lot.
 
Well they say: Always give diplomacy a chance. I have never seen such a courteous immigration office. They really sent you a letter apologising for the delay!!!! :eek: WOW!!! I am impressed.

Anyway, it seems like your FBI name check is still pending. Try to contact the FBI and pressure them to complete it. Use Rahul Kumar's memo at the top of the threads. Also use your congressman's office. Don't write to your congressman. Visit their office and speak to the case handler. Convince them to help you pressure the FBI to complete the case.

It seems to me that USCIS is working on your case and they've showed good faith in trying to complete it. I would give them two or three more months. Then if nothing happens, file a petition for a hearing on Naturalization with the District Court. These petitions are known to magically speed things up.

fragilrl: congratulations on getting "no records" so quickly, though it appears from R. Kumar's attached files that it is possible that your name check is still pending... I think I also need to do FOIPA ASAP. Can you please tell me how exactly you submitted your FOIPA, by mail, fax (number?), or email (address?). Did you send this form: http://foia.fbi.gov/privacy_request.pdf?

Mail it. They need an original signature.
