Hi,
I am in an interesting situation. May be someone can help me out with a good advice.
I had my citiozenship interview in San Jose. I reached there 30 minutes prior to the interview time and waited in room 219.

No one called my name and I waited an waited. After it was about an hour over my schedyled time, I talked to an officer who was calling in someone else for the interview.
He told me that my name was not on the interview list. My Interview appointment letter clearly showed date, time and location. He kept my I-797 and asked me to wait.
He said someome will contact me. When I pressed further, he told me that they had not received my file yet and my interview has to be rescheduled. He also called someone over the phone and she said that they had sent me an interview cancellation notice. I told them that I did not receive any letter. The officer said that I have to wait..

I asked him to give me something in writing but he refused. He still has my I-797 and I don't know what to do now.

I also called USCIS customer service the same day and told them about the same situation. The officer over the phone gave me a reference number and said that he is sending a note to USCIS San Jose to update me about the new interview date. It has been 2 days and I have not received any phone, emil or mail.

What should I do now? Please help me out.

Is there a phone number for San Jose Locala office on Monterey road where I can call and get hold of that officer?

Thanks.

About your missing file

This is not unusual with USCIS. It happened to be back in 2006 and 2007. I was called for interview twice with 6 months difference & both the times I was told that my file was missing.

There is nothing to panic. I would give your local San Jose DO 3-4 weeks time to respond back. Hopefully you will get something in the mail by then. In the meanwhile, please go ahead and schedule an InfoPass with the San Jose office for the 3rd week of Nov (week of 14th) since the following week is thx giving. Make sure you request to speak to a supervisor there even if u have to wait all day. If u don't get a solid answer from her, get a paper n pen and take his/her e-mail address & phone number to get in touch with her and follow up with her after your InfoPass.

You now need to follow up and stay in touch with the local DO. Forget about the customer service. Those people have no idea what they are talking about. That's like their part time job and have hardly any information on your file. They can just look into your dates, thats pretty much it. Making things happen is not in their power. They cannot request file or speed up your process. Now it's you and the local DO who has to sort things out.

Good luck.

You need to be patient. Give it at least 30-45 days before you launch an inquiry with an IO over the phone or via Infopass.

Every case is different

There is no set rule to this. Every case is different. My wife's file was missing and it came to the DO in 14 days. We were never notified by mail. I tool the IO's direct number and kept calling him once a week. When he told me the file is here and I will be notified, the next thing I did was to schedule InfoPass at my local DO. Spoke to the officer there and requested him to get me in touch with IO who interviewed us. I was sent to the 2nd floor where the officer was waiting to receive me. He took us to his office. Asked us couple of more questions and BINGO the GC was approved.

Sometimes, you can't just wait for 30-45-60 days. I would wait 2 weeks and if I don't see any letter in the mail, go to the DO and start talking with officers there and get answers.

Missing file

Thanks everyone for such useful advice.
I am somewhat relieved to read that it could be resolved.

I will schedule an infopass for mid-Nov if I dont receive anything in mail.

Thankyou all.
