I just had my interview on 05/28/10 ....Iterview went well..however I was arrested for 1 charge in July/09.

There were no charges filled....The case never went to court. during my interview I meantioned the same that I was arrested and no charges were filled and case never went to court.

They asked the official letter from Police Dept & Court about the same.

I went to Court house and obtained a copy which quotes as below:

Arrest was made. No complain/charges were filled. however we have 3 years for felony chanrges & 1 year for misdamenor charges to file the charges.

I am little bit worried. Would it possible if they deffer my application for next 3 years???? As DA do have untill July 2011 to file charges...(In real life its not gonna happened)

And one more thing is my Green Card is expiring next year ....IF they do put my application on hold would they renew my GC?

Please advice ....
 
Your case is evaluated on what happened in the past, not on what may happen in the future. As such, they can't delay your application for 3 years pending possible refiling of the charges by DA.

Have you gone to Police ??? Probably you may get more favorable reply them. 10 months no action they might have dropped the case or closed it.
