Child Citizenship Question

Dear All,

Please let me know if my naphew can be eligible for child citizenship

Facts:

My brother is USC and has filed GC for my naphew who is in india (Case with NVC) expecting approval in Marh 2008

My naphew just turned 18 (17 complete and 18 the year began)

My naphew had GC in 2000 but was sent to india for studies. His GC was not maintained.

As per the requirements,

The following are the Act's requirements:

1. At least one parent of the child is a U.S. citizen, either by birth or naturalization.
2. The child is under the age of 18.

3. The child must be residing in the United States in the legal and physical custody of the U.S. citizen parent after having been lawfully admitted into this country as an immigrant for lawful permanent residence.
4. If the child has been adopted, the adoption must be final.

How is the age interpreted?? He just completed 17 and 18 started, he will be entering USA as PR before his 18th birthday

Given this scenario, can he obtain child citizenship?

Was your brother a USC in 2000?

No, My brother was not USC back then. He became USC last year.
