Citizenship eligibility criteria

All,

I completed: 5 yrs (Sep 03 to Sep 08) on GC and more than 30 mths stay in USA in the last 5 yrs. Within these 5 yrs I went abroad and did not retun to USA for 8 mths(Feb 04 to Oct 04). I had this 8 months gap at a stretch

Question: In the citizenship application I noticed that one should not stay outside for more than 6 months. However, in the "checklist flow" it said that the stay outside USA cannot exceed more than 1 year at a stretch?

What is correct 6 months or 1 year?

Somewhere I read thar if the stay outside USA exceeded more than 6 mths, then the GC credit period accumulated before that stay will be lost. If that were true, in the above example, I will lose the GC credit before Oct 04.

I always valued the advice from this forum and I am looking for your guidance. This has implications on whether I can apply for Citizenship in Sep 08 or in Oct 09

Thanks
nvcr

I believe you can be out for up to a year without needed permission, but no more than 6 months to be eligible for citizenship

Trips more than 1 year automatically break continuous residency requirement, whereas trips less than 1 year but more than 6 months assume a break in continuous residency unless you can provide evidence to the contrary.

Hello nvcr,

My wife was outside the country for 8 months for medical reason while she was in GC. But she didn't had any problem in the interview. She is now US citizen. I think you should be fine.

Please see my earlier posting on this matter.

did you send any forward letter explaining the 8 months trips for medical reason along with the N400 application?
Did they ask for any proof of medical reason?
