Hello forum members,
I first of all want to thank all that are taking the time to assist people that need help on this forum. Thankful and Want - most noteably. My question relates to the documents that are required to be submitted to the officer during the N-400 interview.

The Citizenship forum provides a very exhaustive list of required documents, which to me appears to be more tailored for those applying based on marriage or employment. Does anyone know what the requirements would look like for us asylees? Would they really ask for 5 years tax returns and if you do not have tax returns how does one address that with the officer? If this question has been answered elsewhere, I apologize for asking again, please direct me to where it is posted.

From a judicial stand point, you need to provide the same documents as any other applicant for citizenship.

Asylee applicants have to comply with every requirement listed on the form.

What do you mean by not having tax returns? You lost them? You can get copies from the IRS. You never filed? If so, that could be a serious problem unless you did not have to file because of low income. Not paying taxes is a crime and you could lose your green card over it.

Thankful is absolutely correct. Even if you did not have to file due to low income or no income, I would advise you to go ahead and file for all those missed years now. So long as you have filed and are current with the IRS, USCIS will adjudicate your citizenship application.

However, if you cannot prove that you don't owe any money to the IRS - because you haven't filed; or you filed and owe and haven't paid - and do not have a payment plan in place with the IRS; your citizenship application will not be processed and may even be denied.
 
I hope you still have your W-2 statements (and other records) to demonstrate that you were not required to file tax returns. The DHS takes the tax obligations very seriously.
 
I really appreciate your feedback, I am actually going to prepare the returns for all the missed years and file them. I am a dependent on someone else's returns but had no need to file as I have not met the income threshold, but will now send in the returns so that I can have a transcript or whatever is required from IRS when the time comes..... Thanks again.

You might want to find out what the rules are regarding whether or not you are required to file your own tax return for the years you were claimed as a dependent on another person's tax return. Don't hold me to this, but you may only be liable for the years in which are head of household or single - without being claimed on someone else's tax return.

Ok calm down. If someone claimed you as dependent and your income threshold is less than required(its 10k i think), you don't need to file. Have your w-2's in hand in case they ask you.
 
Just check the 1040 instruction booklets. The IRS website has copies for the past three years or so. For older years you can phone them and get copies. For each year compare your income to the figures listed in the first pages of the booklet (under the do I have to file section). If your income was below the number, then you are fine. Just keep the paperwork as proof. Otherwise you will have to file now and pay penalties.

I haven't found anything about Tax returns either. The only case when an applicant needs to provide his/her tax returns is a naturalization on the basis of marriage to a U.S. citizen. Also, in case if an applicant failed to file tax returns, all correspondence with the IRS regarding the failure to file needs to be presented. Other than that, the only documents one needs to send along with an application are a photo copy of Green Card (both sides), two identical color photoes and a check. However I assume there is another document checklist that comes together with the invetation for a naturalization interview. Among other documents USCIS might ask for an individual's tax returns for the last 5 years. :rolleyes:

You just need to send along with the application:

1. Photocopy of GC
2. Photos
3. A check or money order for $675
