So what? Would you hold the same view if your application was pending for years like those victims in the lawsuit? Nobody said name checks aren't necessary. The issue is the lack of explanation from USCIS when someone's case is pending for years for no reason. USCIS might have made progress but not working for everyone.

It is not a question of my/his/her file getting stuck. If you notice, CIS has made tremendous progress - the cases stuck are truly outliers. Even if the CIS system is not perfect, I can understand if 95% of the cases get processed in a timely fashion and the other 5% take longer.

Lack of accountability for delays / lack of explanations still remains a concern though. However, it is a minor thing to fix if the overall process is working well.

I think you are missing the point here. That 5% (even assuming it is correct) in reality comes to tens of thousands and that's a big number. Also, the lawsuit is about the frustation of some applicants who just sit helplessly for no fault of theirs, just because of indifference from USCIS. What people go through during those years can never be underestimated.
 
USCIS is working well, people who stuck in process have legal issues or falling under different categories (blacklists etc). Don't blame USCIS for taking extra time to double check the person before adjudicating his/her status.
and by the way Permanent Residency as well as citizenship is a privilege not your right.

I don't think that anyone is suggesting that the PR or USC is a birthright - only that the Approval or Denial happen in a reasonable time frame.

USCIS isn't really 'checking' anyone for this long timeframe - the file is just lying untouched in some corner somewhere. Case in point - these cases get resolved very quickly when the lawsuits are filed (or even threatened). I haven't heard of (m)any cases where the several year delay actually found anything that was a real security issue.

But, I hear the name check process has been revamped. I hope I don't have to wait the 3+ years for the N-400 name check as I had to for my GC.

"so what?" was referred to the fact that all these "poor victims" weren't able to vote (for Obama, of course - because they all think that immigrants all vote for democrats) and to the fact that these "poor victims" aren't even free to get arrested....

Many people who are PR candicate actually hope USA complete stop immigration at all so that they can go home without any regret.
But as longf as USA still allow immigration, they feel very reget
if they alone leave USA while other stay

Humans ahve all weird feeling. But as long as humans have them, perhaps they are normal feelings
