Hi Ciba,
I really need your opinion, since the situation we are in is quite difficult. My husband\'s company (he is the primary applicant )is about to file chapter 11 (according to the e-mail CEO sent to all employees this morning) or being sold/merged with another company, to avoid bankruptcy. So it can go either way - but the way I understand it - neither way is good for us. The ND for our I-485 is 11/01/2000, and FP are taken on Feb. 20. What happens to us now, and would anything change if all these things happen 6 months after applying for I485 ? Would we be out of trouble then?
Are we lost in any case, since I485 is for future job, and there will be no future jobs in the company that is bankrupt?
Also, we both have EAD – do you think we should start using it or stick to our H1’s just in case – or it doesn’t matter ?
Sorry I know this is a lengthy e-mail, but our future is at stake, and you are the only person I could think of to ask for advice.

Hi Maja,
With a little luck you should have 485 approved by the end of this month.I see a lot of folks getting 485 approval in 30-45 days from FP. Even if that does not happen, one option is to do nothing till 180 days from filing your 485 and then get another job using your EAD. As I said hopefully that that situation will not arise. Wish you both good luck in these hard times.

Thanks you for your kind and encouraging words. I certainly hope that 5 years of waiting and hope will not go down the drain. But it\'s hard not to worry. INS has drained us. My kids only speak English. My country is recovering from war. We have nowhere to go. And only a year left on H1. I guess too late from starting everything from scratch.
It\'s hard to be optimistic when you cannot even plan your future few months from now.

Nowadays CSC is approving 485 cases within
four weeks after FP.
Call FBI and make sure your FP\'S are OK.
Also keep calling CSC and ask if your FP\'s are
in their system. (I heard that some people called CSC and
the IIO helped in transfering the FP from one computer to
another.)
Also try to convince your employer not to inform INS about
termination of your job in case of Ch11.

Hope your case will be approved soon.

I hate to sound pessimistic, but all these stupid RFE\'s that I\'ve been hearing about might dampen such plans.

I really feel for you and hope that everything will turn out fine.

Hi Maja,

I am sorry to hear the terrible situation you are facing. Since your
notice date is very recent, you have to prepare the worst. I suggest
that your busband start looking for another job quickly. It will be
great if both of your approvals come through before the current
company files bankcrucy, if not, switch to another company so that
you can at least get things going, and worry about your status later.
