Hello Ciba,
        My I-140 got approved recently. I am married & my spouse is out of US at present. Spouse will not able to come to US for one or two months.
        In the mean time, I want to file my I-485 & file spouse\'s I-485 later when spouse is in US.
        Do you know of any such cases. Has anyone done that. let me know, if you know of any cases.

I don\'t know a similar case like yours, but I suppose you can either

(1) file I-485 yourself and attach your wife\'s case when she returns
I think the techinical term for this is something like "follow to join";
(2) wait until she returns and file together.

You can wait rather than trying to match your file with your wife\'s file later. Its just a matter of 2 months.
My I-140 was approved in begining of Jan2001, and I have still not applied for my I-485. I don\'t mean you be lazy like me but what the heck. just 2 months.

Hi Rekharajan,

You can always add your spouse at a later stage after you applied your I-485 (according to my lawyer) but before you do your finger printing because once you do your finger prints then you can get your card at any time and now you cannot add your spouse.

Risk : Suppose you did your finger printing today and you add your spouse the same day ( you send your spouse application to INS) and think that you got your I-485 approved with in 25 days and your spouse did not even got Notified date. How does they handle the spouse case now. I DO NOT HAVE A ANSWER.

        Thanks for the reply. Do you know anyone who has done this. Because, I want to make sure that my I-485 application is filed properly. Specifically in my application for the spouse section, for the question \'Applying with you" what should be the answer, yes or no.
        Has your attorney handled this kind of cases. Thanks in advance.
