Ciba and others: DUI and I-485

I had a DUI ticket in Maryland about 1 1/2 years back. The court decision was 6 months of unsupervised probation. My question is:
At the time of filing I-485 my case was still pending for hearing and I did not have enough knowledge about what category does a DUI fall under. Due to this incomplete knowledge, I marked the question under part 3 as \'No\' for any arrests/citations other than traffic violations. Now I have an interview coming up at my local INS in Baltimore next month.

Does this pose any problem? I am ready to explain them the above situation and provide them with the court ruling if they ask me. If they do not then is it o.k. not to bring it up at all?

Has anyone with a DUI pass through INS interview and get their GC approved?

All DUI guys.

DUI is a crime. You must have been arrested. That is why it is a DUI.

You must answer YES to the question.

If you are filing 485, pls attach the Court papers with the disposition report (in case you have completed all the sentencing). You are OK. You won\'t even get an interview.

If you say NO and finger print reveals (which it will), you are sure to be interviewed.

DUI is a proper ARREST. It is not a simple traffic violation, even though you are chaged with Vehicle Code.

This is out of experience. Don\'t shy away from it and get into trouble.

If you answered NO at teh time of filing and got it later, it will show up as inconsistency.

If u r scheduled for interview, take the court papers which shows the case disposition.

I was not finger printed I am not sure how it would show up. Also, at the time of filing I did not have enough knowledge about the nature of the DUI arrest. I was of the impression that it was a serious traffic violation. However, only when I received the court notices to appear for the trial I realized the seriousness of DUI. By which time, my I-485 was filed.

My I-485 was filled by my attorney and I had to just sign it.

I am not sure, if a person does not have enough knowledge at the time of filing will help in anyway in my case. However, I will take the court disposition to the interview.

No problems. Dont worry. But definitely get a dispostion note from the Court once u have served the sentence like fine, weekend work and any DUI classes.

You should be absolutely fine.

There are millions who are a DUI. You are not alone and you are not a habitual offender.

It is just a lesson for us.
