CIBA and other I-485 waiters - waiting since Oct-2000 (ND)

I am still waiting for my approval

I have RD of 10/2000 and i did FP twice already

once in 04/14/2001
once on 08/11/2001

the problem was I missed my original FP which was slated to happen
on the first week of feb-2001 and unfortunately i was out of country
then. If I had completed my FP as per schedule, perhaps I would have got
PP stamped long time ago.

I joined my new job with EAD (after crossing 180 days threshold). My
new company\'s attorney suggested that i should process one more H1B.
It\'s not required by LAW that i need to have another H1 since i am
working on EAD. She was trying to exploit the situation. I categorically
said "NO" to a new H1B. She gave some stupid reasons to process a new H1.

I am just praying and waiting for my GC approval lest these stupid
attorneys try to confuse, intimidate and even threaten you unclassified
examples.

CIBA told me in one of his e-mails to me, once FP notice is sent, the case would be automatically assigned to an officer, since i didn\'t do my FP on time, could it be possible for the IIO to misplace my file or re-assign at a very later date?

and am still waiting.. suggest me some quick ways to get my approval.

I called IIO several times to find out the status, they were of
not much help me to anyways... Please suggest me some ways to tackle
the situation.

It\'s totally frustrating...

Thanks in advance for your suggestions....

Hi Pachai,

I understand your enxiety and frustration, but just like
many lawyers will tell you, the only way you could do right
now is just wait. You are right, your case would have been
approved if you had done FP on schedules.

My guess is that the officer could not do anything when
he/she got to your case, and so set it aside.

I want to clarify one thing. Sending or receiving FP
notice does not mean a case is automatically assigned. As
we know from the experience, finger prints have nothing to
do with whether a case is assigned or not.

Whit many ND 02/01 or 03/01 approvals, there are signs
that old cases are being cleared out. So keep your spirits
up.

AOS STOPPER-G-325

When someone applies for adjustment of status, they must complete a
form G-325A biographic information form. This form has four pages, all
with the same information. When the INS begins processing the AOS
case, they send out the G-325A pages as follows:

1. One page goes to the INS records division;

2. One page goes to the FBI to look for domestic and international
criminal activity;

3. One page goes to the consulate that has jurisdiction over the
applicant, to request any information that the consular post may have
about the applicant; and,

4. One page goes to the CIA to determine if the applicant has ever
been involved with terrorist groups or international drug dealers.
