Children of green card holders

Hey guys, My dad just got his green card, so we applied for my little brother (17 years old) for his green card as well. We sent in the I130. Uscis received it on May 23rd by fedex... so far they havent cashed checks, and we havent received a receipt.

I checked Uscis site for processing times for children of green card holders. We live in IL, so i checked nebraska service center, but there was no info there. CSC says they are working on January of 2005.... so maybe we are the same as other service centers??? anyway, i am not sure what the processing times are, so I thought I would post to see if someone has experience with this...

If anybody has a timeline for the child (under21) of a permanent resident, please post so we can all have a rough idea of how long the process will take. Thanks a lot in advance and good luck to everyone :-)
 
GCmaze's father got his GC under IR0 category. His father has applied for his unmarried and under 21 son under that category.

My mum has applied for my brother too but above 21 and unmarried. As far as I know all the family cases are being forwarded to CSC once they are received by NSC or TSC, hence you would not find it under NSC. Due to this forwarding of cases, you would see some delay in getting the receipts.

In our case, instead of sending it to TSC, we directly mailed to CSC on 5/18. Time will tell if we've saved time or not or for that matter, the right thing!

I didnt know they were forwarding everything to CSC...buti guess that makes sense, since there is nothing in NSC... according to the timeline in CSC, they have a waiting time of about 1 year 4 months for below 21 yrs old, and 1 year 3 months for above 21 years old... I guess this is pretty good for children of LPR's ,

Needurhelp, lets keep each other updated on our progress... i'll let you know the second I hear anything from USCIS.
From the looks of it, not a lot of LPR's are applying for their children... i was hoping there would be more people so we can compare notes:-)

My dad filed for my sister (over 21 unmarried child) in June 2002, so 1 year and 3 months waiting for what petition date and year? Also, CSC is processing applications with receipt date Feb 2005, so how does it work for someone who applied in June 2002?
 
Having your I-130 approved means you're eligible for a benefit, but it does not mean you're eligible right away. You must visit the State Departments' Visa Bulletin and look at the appropriate Family Based Category to see what priority dates are current. You can get your I-130 approved in 2 days if you like but you will see no benefit from it, until your priority dates are current and a visa number is available for you to be issued a visa.

Only immediate relatives of US citizens have current priority date, everyone else is lagging behind, some are lagging a lot.

Ok ... i am confused now..... I thought that aproval of the I-130 means that you have a visa number available.... and when that number is available you can apply for a change of status by submitting I-485...
from my understanding, when CSC says they are working on cases submitted in January of 2005, it means that people who submitted their I130 at that time, should receive an aproval soon. once they get that, they can submit their I485... when I 485 is submitted, they can apply for work authorization and travel documents, and they dont need a visa to remain in the USA... so realy they should be fine until the actual green card is issued, which could be in a year or 2 after that... this is just what I understand, no one ever actualy explained this to me.

Please correct me if I am wrong.... I would realy appretiate the guidance. thanks in advance.

To ur dismay, twopac3 is correct.

Other than spouses and parents, everyone else comes under per year quota limit.

For siblings or children of GC parents ( even though they are one day old), the wait is long. For that matter, even USC's kids have to wait longer too. They have to wait until their PD is current which is way out there in future. First step is to get the I-130 approved. Based on the long wait, it really doesn't matter if they are processing the I-130 faster or not. Currently its taking about 5yrs for unmarried and less than 21.
 
:( thanks needurhelp.... I had no idea!!! so the waiting time is 5 years for children of LPR's?? where can I find those dates? is it any different for under21 children compared to over21?? :confused: sorry for all the questions... this is all brand new to me. Thanks in advance.
 
Also, let us watch how Congress will read new bill next Monday, regarding increasing more visa allocations for family based. From 260.000 to 480.000 to eliminate backlog! :rolleyes:

that would be a relief for so many people wouldnt it??it only makes sense... if they are allowing illegals to get citizenship, the least they can do for legals is speed up the process....

Look, what I believe, in future, and if the Goverment want fight illegals, then not only border control,but complitely change immigration laws! I think or hope the are on the way. Because a human factor works in disperetion to get our kids or wife, husbands by any means! Tell me if I,m wrong! Its just too much pain of separation for so many years from your loved ones and, yes we also thinking one day how to get us closer, even breaking the law! But we did not, because we understand no matter how much pain, we need to do it right!
Of course, its a long topic...

one more question

i was just curious.... how do we get a priority date?? do we get it on the day they receive the I130 application?? or do we get it when they aprove the I130?? thanks a lot.
 
nothing so far.... i checked murthy.com, and they havent updated anything... i am hoping if some one knows something he will let us all know.
 
We've received my brother's NOA from CSC with RD as 5/22/06 and ND as 6/5/06.

The app was mailed on 5/18. Though we come under TSC, we mailed it to CSC. All the family based apps though mailed to TSC, they were getting forwarded to CSC. To save the time (due to transfer), mailed the app directly to CSC. Right now, don't know whether we saved any time.

GCMaze's case timeline will throw some light on this.
