Children for DV-2012 entry

Hello,

I have 2 questions please about this in the entry for DV 2012:
"Children include all biological children, legally adopted children, and stepchildren who are unmarried and under the age of 21 on the date that you submit your entry"


1) What does it mean? Do I have to declare a child if he is more than 21 and unmarried?

2) I have a child who is 20 years old and unmarried, so I have to register him. Let's say I win the lottery, my child will be 21 by the time of the interview. Does my child gets a Green card too if I win?

if your child is more than 21 years, then you can't declare him

you need to include him since he is under 21 years. The decision as to grant him visa depends on the consular officer who will conduct the interview.

Married children cannot be declared even if the person is 18 years.
 
You have to add the kid who is 20 but by the time the NL is won or when you get the GC you will only get it for the ones under 21...not nice isn't it...:(

I have to rgister him but when he turns 21 he wont reserve a GC ....
Ammeck09 seems to think different.
So you think it's gonna be a problem if I dont register him (I wont need to tell them I have this kid at the interview since he will be 21).

Something heard about Childrens Act? That means, that all children under 21 can apply on parents file, while they turn 21 at the time of the interview. They also get a greencard too. Important: Must be 20 at the time of application.
 
Entries must also include all children legally adopted by you, and stepchildren who are unmarried and under the age of 21 on the date of your electronic entry , even if you are no longer legally married to the child’s parent, and even if the spouse or child does not currently reside with you and/or will not immigrate with you. Note that married children and children 21 years or older are not eligible for the DV; however, U.S. law protects children from “aging out” in certain circumstances. If your electronic DV entry is made before your unmarried child turns 21, and the child turns 21 before visa issuance, he/she may be protected from aging out by the Child Status Protection Act and be treated as though he/she were under 21 for visa-processing purposes.

If at eDV he/she is <21, you MUST include.
But when it comes to GC, he/she faces a complex 'formula', to see whether 'age out protection law' has SAVED him/her or not !!
