My family got GC about three years ago. In Dec 2004, my wife went to India and got my elder son ( age about 8 and half years ) admitted to a boarding school in India. I have the following concerns
i) How long he can stay in India ?
ii) What permission do we need to apply from USCIS so that his citizenship is not delayed ?
iii ) Any other suggestion for our situation.

Thanks,

Rajiv

under a year

you need to research the application to preserve residence for naturalization purpose

iii ) Any other suggestion for our situation.

If your child plans to be outside the U.S. for longer than a year but less than two, then he needs to apply for reentry permit WHILE in the U.S. Reentry permit (form I-131) takes about a year to get, but he doesn't need to be in the States all that time. He only needs to be in the States to APPLY for it. Keep a proof that he was in the U.S. while applying for it (airline ticket stubs, etc). Re-entry permit gives the permission to be outside the U.S. for a period up to two years from the date it is issued.
