Can anyone who has any experience of any case status in this repect post their experiences and outcome (if any) here?

I 824 was submitted for son as follow to join, within one year of I 140 and pending at the enactment of the CSPA At the time the I 824 was sent son was under 21years

The first I 824 was denied as Texas errored in working too early (before husbands I 485 was approved) pending at enactment of CSPA and denied Oct 02

Texas advised for husband to submit new I 824 once his I 485 was approved. This second I 824 has been aproved and cable sent to consulate


Cable sent 11th Aug

Still waiting for further info
 
Actually, mine is a different story.

It's about my USC dad who actually filed my petition when I was only 19. And I got my first notice from NVC when I was 23. They gave my case number, priority date etc and the info that there's no visa available yet for me. And sadly, I fell under F1 or unmarried daughter of USC.

I called the USCIS the other night and asked about the CSPA. The CSR told me that based on her understanding (because I told her the story), and the information she has there, I am eligible to apply for CSPA. She told me to call NVC which I did.

The NVC person told me to write them a letter of request to review my case. And today, I sent the letter to them.

My question now is, how long am I goona wait fro their answer? and how long is the process if I'm eligible?

I think because your father is a USC and you were under 21years of age at the time he filed for you , you should be protected (I hope I am right in this) as your age should lock in when he applied for you

The trouble with the CSPA is that many attornies and immigration officals are still trying to get to grips with it

I would suggest you speak with the lawyer I dealt with if you do not have one. If you would like his contact details just send me a PM. He has helped my family a great deal and is very good.

I would ask if he could write a supporting letter for you and send to the service centre via your congressman in the USA (of where you are or will be living)
