Either you're not reading or unable to comprehend what others on this thread are saying. If USCIS believes YOU DO NOT HAVE LEGAL CUSTODY of the child, he CANNOT be a US citizen through you.

Did a judge / court order give you joint legal custody?

A permission letter from the mother saying the child can live with you is NOT enough.
 
Actually, if the foreign divorce decree HAS NO CUSTODY ORDER, then the parent who is raising the kid is presumed to have LEGAL custody per Department of State.

However, the foreign divorce decree that the OP submitted seems like the court awarded the custody to the NON-CITIZEN parent. So there is NO WAY this will get overturned.
