• A child born abroad, in wedlock, of one American citizen parent acquires citizenship only when the citizen parent was physically present in the U.S. for 5 years or more prior to the child's birth, at least 2 of the 5 years occurring after the parent had passed age 14.
I had been in the States for more than 5 years with Green Card, but I moved to China right after getting citizenship. Is this situation still meeting the request “citizen parent was physically present in the U.S. for 5 years or more prior to the child's birth” or not? (Does Green card years count? Or it has to be Citizen years?)
My husband is Chinese, and I plan to give birth in China since I still have another 2 years of contract with my company in China. However, since I will move back to US after that, I wanna make sure if my child will be US citizen in this case.
