Chennai - H4 visa stamp with one missing paystub

Hi guys,

My employer did not run payroll for February and he has been dodging the issue ever since I confronted with him. We were all paid a personal check for the month.

My wife is in india on a visit and needs to apply for H4 in chennai. What effect would one missing paystub have on the visa application? Is there anything my employer could do? Do we need to submit all paystubs for this year?

--- it depends if they ask for missing pay stub, you dont know what they ask till you apply for H4 visa with consulate

----Employer should explain it on company letter hear why they did not generate pay stubs for particular month or why he paid through personal check

Should not be a big deal if....

... Total pay for previous years is close to the salary mentioned in LCA and if it is indeed couple of pay checks that are missing. Normally history makes most of the difference.
If you have had decent earnings in all the years you have been on h-1, then it is not a big deal. Problem is that if you have some thing missing that might prompt the consular officer to ask for more evidence. For example to show the original offer letter or something else. How is your company ? Do they have good reputation ?

I have never had any problems with my w2's before. My employer seems to be in kind of a rut and he probably wanted to save some money on the tax for february this year. I am not sure what kind of reputation my company has in INS records; Personally, I think he doesn't believe in rules and regulations. :)

I got an email from the Chennai embassy asking for all paystubs for this year. Do they check all documents when you submit them or later when you are waiting? If they ask during submission, then I can submit the employer letter. Otherwise, I can just have the employer letter in hand and submit it only if asked.

Normally their website says that "w-2s for al the years the primary applicant was on H-1 and all the paychecks in the current year".

I would say that many employers circumvent the law if possible using loop holes. But reputation that I was talking about is in terms of numbers h1s filed and number of people on bench etc.

Anyway, like I said if it is indeed one or two paychecks that are missning then I don't thing it is a big problem. When my wife went for visa, they did look at the paychecks and w-2s, but not meticulously (How ever I never had a gap in my pay checks.) So unless your w-2 incomes are very low or your pay amount is very low they will not bother to verify further. But it is all in the hands of the consular officer. If for what ever reason the officer gets a doubt, then he might ask for more evidence.
Get a letter from your employer stating that u have been on vacation with out pay in that month. But DONT DONT show the letter unless the officer asks why you were not paid in that month.
Your wife has to be confident and give answers boldly.
