My current employer applied for H1 well before my previous H1/I94 expiration date. BCIS issued H1 approval without I94 extension after 5 months from my I94 expiration date. So I had to go back to India in order to get my I94 extension. Now I am applying I140/I485 concurrently. Does BCIS checks for my previous out of status (My Lawyer says I was not out of status as I was working in that time while waiting for approval) when processing I-140?
