I have a situation in here, and I really need you to share your ideas guys, of course, if you know what you're saying...
so, I came here to the US as an international student. after 2 years I met a beautiful girl and we decided to marry. I loved her and so on. anyways, we've got married, she got pregnant... what a beautiful life! I had the first interview in INS, I passed and got conditional green card. However, just after interview and approval the baby was born. and guess what?... I've got a beautiful... african-american boy... that would be fine if she were african-american, or I were african-american, but... neither of us are african american! damn what a miserable life! I'm destroyed... now, of course, I'm not gonna live with her, my wife. I want to divorce because she is a b...h! so you guys, tell me what's gonna happen if I'll get divorced. the thing is that I'm still on conditional green card, and I dont know how it might affect my second interview for a real green card. so anyone, who knows something please share your ideas. thanks...

I belive you need to read the paperwork really good. They are some cases you still can get your condition removed. But frankly, I would deffenetly consult a lawer about this one.

I am sorry , This is a very tough situation .
You could go either way & you will be protected by law. You can forgive her ( You said that you really love her ) and support them . You save a family and this would be awesome .
You could also get a divorce , and have your conditions removed on your GC after 2 years , based on differences you have with your wife .
You have to think it over , and it should be your decision.

Shiiiiittt... Sorry to hear about it, mate. Well, you entered your marriage in a good faith, but your expectations were not met. I think you are able to get a permanent GC without big complications, but do consult a lawyer. The bottom line is the marriage was bona fide, but your spouse made a fine mess of it, and her baby is a living evidence.

Hopefully you'll get some good advices here, but regardless what you'll find out you need to talk to a couple a good lawyers: a divorce lawyer and an immigration lawyer.

Try Ron Gotcher's forum too, he's a good immigration lawyer.

Not long ago, I saw on TV these twin girls from England with both caucasian parents and one was black and one was white. They couln't explain it maybe you should take a paternity test unless you know for a fact that she was fooling around. This is just my opinion. Good luck.

Agree with above poster- unless (1) she's already confessed to cheating on you or (2) youv'e taken a paternity test (neither of which you specified in your post) I wouldn't jump to the conclusion that the baby isn't yours. Who knows how far back in your bloodline what happened.

For example, I work with a coworker who looks completely Asian but she has a Lithuanian (blonde/blue eyes) grandmother. Her child looks completely white.

You never know. If it turns out the child is really not yours, hire attorneys. You entered the marriage in good faith, the USCIS should consider. Good luck.

Yes that's true.

For example, Ari and Publicus, they have normal, beautiful parents and look at their picture:

My apologies to the OP, but I couldn't help it...and a smile once in a while it's a good thing, even though I know two guys who are not amused on this (Ari and Publicus :p :D )

Well, hello there my slavic brother :) Yeah, in this case I don't think you had any africans in your line of ancestors...

Dani:

Pushkin, perhaps? :p

But, seriously, do genetic testing and go from there. I do think that rim's case falls under "good faith marriage", but he probably WILL need a lawyer (or two - divorce and immigration, as someone else pointed out). Rim, what state are you in?

Paternity Test .

I am waiting for Ari and Publicus to get into this thread . Suzy , you have a butt load of trouble following you . Lol .

A paternity test is necessary . You will need to hire an Attorney. You should be able to remove conditions on your LPR as you did enter the mariage in good faith .
