Charges dropped 6 years ago and Citizenship application

Hi I was charged, arrested and fingerprinted more 6 years ago (Petit Larceny Theft) for $ 138.00 never went to jail. I received a letter to paticipate in a PTI class since this was my 1st and only offense. I went to this class for like like 6 saturdays. After PTI was completed (5 month after) my charged were Nolle Prose (dropped by the state) After that I never had any problems.

I applied for Citizenship and I mentioned about arrest and PTI completed. I included Disposition and arrest record. The arrest record only shows the date of arrest but since was so long ago that is all they have. I also mentioned that I got 2 speeding tickets in 2002.

I'am married now with a US citizen and I have a 2 year old doughter. This was a mistake I made went I fist came to this country and I really regreat it
Does anyone know what are my chances to become a US citizen?
Has anyone been approved with same situation?

It plays in your favour that this situation is more than five years in the past -plus you have not been convicted to any sentence of more than 365 days. No other offenses after that ... not perfect but you should be clear as far as this brush up with the law and your N400 are concerned.

If you search the forum you will find a several other individuals who were in comparable situations. Some did not have the advantage that they have the past five years on record to show that they indeed have a 'good moral character'.

And also remember ... people are reading your petition, not machines. So if you wanted to you could attach a statement to your N400 that explains your answer to the arrest/conviction question. I don't think it is required but it sure does not hurt ... after all 'good moral character' is a quite subjective determination by an adjudication officer.

If you wanted to - for a piece of mind - you could have your situation reviewed by an immigration lawyer. You could share far more detailed facts with him than with use here.

Yacade ... re-reading your post I realize that you already send your application. So whatever you will hear here does really not matter, nor will it make your wait much easier. The best advice would be to forget about the application for the time being. You'll hear during the interview how everything turned out ... very likely this will not cause you any headache after the interview. Let this situation not distract you from preparing for the civic test.

It will be in your best interest to have an immigration attorney who is familiar with criminal laws with you in the interview ;)
 
Thank you very mucho for your answers I went to see and attorney and he said I should be OK. I wanted to confirm with you since he left me with more questions than answers. Once again thank you very mucho I hope to see here that someone gets approved in the same situation.
