Changing status back from Advanced Parole to H1

Hi, all.

Is it possible to change my current status, AP, back to H1? Here is the scenerio. I am travelling oversea and when I come back to the US, I get re-admitted with H1 instead of AP.

The reason is because I was told that if my greencard is approved while I am away, I would not be able to come back to the US with AP as it is void at that time. I believe I could still come in with H1 though and that's why I am inquiring if it is legally possible to re-enter the US with H1.

Thanx,

SK

Yes, you can if you have valid H1Visa stamp. If your I-485 is approved while you are out of US and enter with AP then you don’t have problem entering with valid AP at POE they will check the USCIS computer and will admit you and will inform you’re your I-485 is approved and will inform you to go to local USCIS office next day to get temporary GC stamp on your passport. Who told you that if you have valid AP and I-485 approved you will not be admitted?

Temporary GC stamp ?

Temporary GC stamp ?

I never heard anything like Temporary GC stamp ?

Ginnuuuuu clarify !!!

My attorney said the moment my I485 is approved, my AP is void. So if I were to enter the US with AP while I485 is approved, my AP is counted void and I don't have the permit to re-enter the US. That's why I was trying to find another option hoping that approval on I485 have nothing to do with H1.
