Hi,

Me & my daughter (5 yrs old) have GC. I can apply for US citizenship by Aug06 (5 yrs - 90 days).

I added my initial to my daughters name in her birth certificate in INDIA. Now her name is sona U.K ( where u --> mothers initial, K--> fathers initial) as per birth certificate

But in INDIAN Passport & GC her name is Sona K(alidas)

1. What is the procedure to change her name as Sona U K in INDIAN Passport & GC
2. Her Indian passport is expiring this month.
3. When i apply for US citizenship, shall i request a change of name for her?
4. Do i need to apply Dual Citizenship after i recived my US citizenship only?
5. In that case, when applying for Dual citizenship, shall i request change of her name also?

Let me know the procedures or information anybody who have come across.

1. You may've to change her name in your local county courthouse in the US. That way you have a proof that will be easily accptable in the US. Local County Courthouse (where you live) can handle this. Check the Indian Consulate's websites under Misc services for name change. I am sure you can do the name change with the copy of the proof when you apply for her passport renewal. For green card, You will file I-90 Form and get the name changed.

2. File for Indian passport renewal after you've change the name in the local county courthouse so that name change and renewal can be done at the same time.

3. No. You will only apply for your citizenship. Just list her name on your application. She will be automatically a US citizen, when you take the oath, provided she is under 18 on that day. You can apply for her US passport along with you and file N-600 to get a Certificate of Citizenship for her. This certificate will be her proof of US citizenship.

4. You have to become a US Citizen first. On the day you become US Citizen, your Indian citizenship will automatically seize to exist. After that, if you can choose to apply for Overseas Citizen of India (OCI) or tourist visa to visit India. OCI is just starting now.

5. You will have changed your daughter name by that time anyway. You will just apply for your daughter's OCI in her current name.

Hi,

Thanks for the reply.

I checked with local court house for name change for minors. We need to file the form for name change & they need consent from both parents & the cost is $315. I need to publish in local newspapers for 4 weeks & on the hearing date parents & child need to present.

Once i received the court order to change name, i need to apply for replacing an green card because they need a copy of newspapers (in INDIA & US) & copy of court paper as a proof for name change. Once i received her green card with new name only, i can apply for a new INDIAN passport because it is expired after 5 years & i cant renew her passport.

Once i become a US citizen, Shall i change my daughter's name at the local county court house?
and then shall i apply for US passport for my daughter with the new name?
This way i reduce time, cost & then i can apply for OCI with her new name in US passport.

Is the above options are ok or do i need to start the name change process for GC & Indian passport?

Please let me know the best option depends on ur previous experiences.

Thanks
Uma

You can wait until after you become US citizen to do the name change. This will save you some money is you are sure that your daughter will not need to travel internationally in a hurry. With expired Indian passport, she won't be able to travel for a while.
