Hi,

I came to U.S with my parents on a B1 Visa in December 2006. I am 24 years old. After coming to U.S i did extend my B1 visa for another 6 months. Before i tell you more my brother is a U.S citizen. My brother applied for AOS for my parents and they got there non conditional Green card last year.

I always wanted to study more so i applied for F1 in an institution before my I-94 get expired, it was probably November 07 when i applied for the F1 visa. On April 19 2008 i got a letter from USCIS that they need additional information from me. So i send each and everything which they asked for before the specified date which was June 17 2008.

Months started passing and i was waiting for my visa but never came. In january 2009 i called the USCIS offiice and tell them it had been over 6 months that i have not yet received any decision on my case. They told me wait for a month and we will notify you.
In less than a moth a got a letter from USCIS that my case was ADMINISTRATIVELY CLOSED!!! on September 2008.

I know that administratively closed cases are abandoned after 1 year from the date it was closed.
lawyers told me that since they had not specified the time to leave the country so keep living and in the mean while i should look for getting married to a U.S Citizen. they told me that once i get my green card i can study after that.

My Question is what is the most appropriate thing for me to do rite now coz my whole family is here in U.S. If i reopen the case there is most likely that they might reject my application. Or should i wait for my application to be abandoned and then apply again for the F1 visa from zero. I also dont know either i am out of status or not?

Please help me out which is the best possible option for me.

MARRIAGE FRAUD IS SERIOUS; DON'T EVEN THINK ABOUT IT. The only way for you to remain is via a legitimate marriage to a USC due to your illegal stay in the US. Leave and start serving your ban with the hope that you will be readmitted on the basis of a petition by your parents in the future.

You do NOT qualify for an F1 so don't waste your money.

Yeah the lawyers advised me that the only thing work out for me is to get married to a USC. By saying that he meant a legitimate marriage not just for getting my papers done.

Another thing, i never got anything from USCIS stating that my case is denied and i had to leave the country. Still when i go to USCIS website it still says my case is pending since last year. I know they dont update the site regularly but an year period is too long. My lawyer told me since it still says your case is pending you are not out of status.
People please give me some input on this.
