Changing lawyer for AC21

I wish to change my lawyer for AC21 as my existing lawyer represents my company. Is my existing lawyer obligated to provide information about LC, I-140 and I-485 applications? I do not have copies of any of the applications.

I believe, LC is important because that has the details about the job description and responsibilities.

Yes they are obligated

The company lawyer is obligated to give you all those documents. You can demand originals of the I485 receipts, I140 approval (if they have not sent it to INS) and certified copies of LC applcation and LC approval.

Depnding on how sociable is your relationship with your company/lawyer, you could get it on your own or can ask the new lawyer to file G28 and send a request to the company lawyer.

Jaxen, thank you very much!

Thanks a lot for the information. I talked to my lawyer and he showed willingness to represent me. I am glad to know that I have both the options open (changing lawyers or retaining the existing one).

I was under impression that LC and 140 belong to the company and the lawyer may have right to refuse.

Now all I need is wait for RFE. I may get lucky, too.

Q. if you leave your company and the company lawer is representing you,,, how exactly can that take place? Unless you get a RFE,their role is mute, isnt it? In other words, what should be the legal binding agreement between the lawer and the applicant when the application has already been applied for?

Thanks jaxen and sunny

Sunny:

Yes. I will need the lawyer services only when I get an RFE. At that time, I will have option to either sign a new contract with the existing lawyer or get a new one. As I understand from this thread (thanks to jaxen), I have both options open. I wanted to confirm this before I approached my existing lawyer.

Jaxen:
Actualy my existing lawyer is not my company's lawyer, but a law firm hired by my company on a need basis. Therefore, I don't see any risk arising due to the conflict of interest. I will definitely have a new contract.

Also, he has witnessed me help my existing grow and is interested in being hired by my new company after I get GC.
