Changing Jobs after 180 days in 485

I hear from everyone that as per law you can change jobs after 180 days. I have even had an RFE to which I have responded and am waiting for approval. 485 was filed in 1st week dec 2001.

I am getting a good job opening and want to take it if there are no problems that might come up.

My new potential employer does not sponsor green cards and I have an EAD until end of this year which was processed thru my current employer. Also have applied for a renewal of EAD.

Should I take the new job and do I need to tell my new potential employer about the GC process. They have not asked so I have not said anything until now since I am under the impression that I don't need sponsorship at this late stage in my case.

You need to inform him GC. He may not sponsor you monetarily . But ask him whether he will be providing required documents/ Letters as and when requested by BCIS. It looks silly but happened with my friend
His company did not include sentence 'we will support him to get his green card'. And attorney was pressing for that.

He needs to know.

I would say after RFE they don't send another one. But never know. Atleast your new emploer provides some kind of employment letter, pay stubs, supporting documents you will be fine.

My take on this

Once your 485 is filed any particular employr ceases to be the owner of the process. You own all the docs like 485/EAD/AP etc.,

Do you have to inform the new employer about your GC?
No need but no harm either.

Would you need supporting docs in case of another RFE?
Cant comment on will you get another RFE. But yes if it comes you need supporting docs, Which if you are following the normal way of being recruited, you should not have any problem. Having replied to an RFE (I am assuming it was an Employment based RFE) you know what they normally ask. Payslips(you should have them anyways), Employment letter(which your employer should be in a position to give since he is not making any commitment, even when he says 'the prospect for continued employment looks good')

I think you might have problem in convincing INS/BCIS, your hopping between jobs. If you can justify that you might be ok.

Thanks and Regards
