Changing job in 485

Hi friends,

I am in a dilemma and would be very grateful if I could get some advice on the following questions/comments.

1. I have an approved i-140 may 2004 with an EAD card valid until 03/2005.
My i485 was submitted in dec 2003.
I have a different project now and so will relocate to a different place and so the lawyers will intimate VSC the change of address.
I am concerned as this could delay the 485 process.Please advice.

2. I want to change job and want to remain in the same city as I am presently so that I dont have to move.Should I go ahead and get a job in current city?It is not the same position as the one in my labor.I am worried as I dont have finger printing done and have just cleared 6 months after applying 485.

3. If i can change job, then should my new company file the change of address(different apartment in current city)?Also does this delay the fingerprinting/485 stage in general?

4. I am thinking I will go for AC 140 but that depends on the current company's lawyers.Is this advisable?What reason can i use to convince for persuing this process?

----- you are eligible to use AC21

----- If you change to diffrent city or state DONT request your I-485 transfer let it be with same service center, your lawyer just need to update your new address on I-485 if you change city and no need to transfer I-485 to diffrent service center

----- you are correct, it may delay the process, STOP your lawyer to request I-485 transfer and by law it is NOT needed to transfer pending I-485 to difrent service center

------ YES you can be in same city or any other city or any part of US
It is not the same position as the one in my labor.
----- if you want to use AC21 then on future job offer letter from new employer you need the same/similar job. it is better to have same job title and same skills as on approved LC, dont create problems joining job with diffrent skills

------ FP done or not done is not a problem, before I-485 approval they are going to ask for Fingerprinting

IF you move or change do the below:
1 file form AR11 for address change
2 update NCSC on 18003755283, your new address, provide them your ,WAC,EAC or LIN # of I-485 and reciept # of any pending petitions with service center, provide the receipt#, your name, DOB, A#( A# is on I-485 filing reciept)
3 write letter to service center for address change on your I-485( if you have spouse I-485 pending He/she also need to change address on her/his I-485) or any pending petition with them provide your past and NEW address, attach I-485 receipt copy, write your name, DOB, A# on cover letter. Send the letter to your service center with certified return receipt and out side the envelope write in big bold letters ATTENTION: ADDRESS CHANGE

---- you have filed I-485, why you want to go for AC-140??? the day you file I-824 your I-485 will be abonded, and with CP no AC21 and your EAD ,AP will become invalid as the base for EAD ,AP is pending I-485, my advice dont thnk about CP , with CP no appeal, no motion to reconsider and no AC21

My service center is VSC.Even with the change of project and change in address if i stick to my present company, it will still remain VSC.

However, if i decide to quit the present company and take a job with a different company in CA, my service center I am assuming will have to change from VSC to CA.Thats why I am hesitating to take up a different job.
please comment.

About AC-140, I have a H1B which is valid until 2007.Most Ac140 are speedy and the time taken is very fast.Therefore I thought of taking a risk and go to Mumbai consulate which processes my home state's application.

So what you are essentially advising is
- Take a job with another company
- Do all of the 1,2,3 steps
- Wait for 485.

The problem is my labor was applied as a junior engineer and I have moved to management.Even if i change job, I would not want to go back to 3-4 levels of demotion.Please comment.

----- no, your I-485 WILL REMAIN WITH VSC, if you or your lawyer dont request transfer and let it be with VSC transfer will delay the process, just update your new address with vsc on your I-485
Thats why I am hesitating to take up a different job.

----- Do you think with AC140 GC will be approved? no, you need same job as on LC. even if you change employer using AC21 then your skill has to be same as on approved LC
