Today I got my PP stamped at San Jose.
Can I change my employer now? There is tremondous pressure
from my client to convert me from Consultant to Permanent.
Any risks?

Thanks.

docs required?

Hey XMOON,
what documents do you need to take with you for stamping?
or what documents do they really ask for?

If you quite shortly after getting GC stamp, INS may withdraw your GC. This is how they may come to know :

1. You employer can ask INS to cancel your GC because quitting right after getting stamp indicates that you did not have intent to work for this employer permanently (INS calls it fraud).
2. If above does not happen and suppose INS never knows about your quitting, there is another way for INS to find out. When you apply for citizenship, INS goes through your past immigration history, they might notice it and raise questions and if not satisfied, they may cancel your GC.

Play safe, don't quit before atleast six months . Although nobody has defined meaning of "permanent" but most people think that staying 6 months to 1 year is safe. If current employer lays you off due to financial/business reasons, you will be ok.

Many people have suggested staying in the current job for 6 or more months or INS may revoke the GC.
Can anyone point us to the section of the law that actually states that? Or is it just a suggestion by some attorneys? Heard of anyone getting problems when interviewing for citizenship because they quit too soon after 485 approval? GC revoked?

I got my passport stamped today and the IIO told me I'm no longer bound by my employer and I can change job if I get a better offer. With AC21, you can change job even before you get your approval, don't understand why you cannot change once you get approved? seems contradictory to me....

well , of course it's always better to be on the safe side.

follow goodsaints advice..it is bang on

net ..no rule which defines what i safe...what good says is real good..stick on for one year..or best get laid off..what a paradox!

Your best bet is to get lay off. I have seen couple of postings by jaxens on this portal giving examples for the ppl who landed in trouble while going in for citizenship . Or stick to ur present one for 6 months. Irony of AC21 is nothing is clear so just hang on for some time if u can and make sure ur employer terminate you.
