Changing from AOS to CP

levelheaded

Registered Users (C)
hi All,
My CN is very high, 16K range for Asia but when I got NL in June, I just chose to do AOS as I didn't want to jeapordize my current F1 status "in case" sth didn't work out in CP interview back home. So after going through all the forum threads it's obvious with a really high CN like mine, only chance I have is to do CP and I believe I still haev time to change it to CP, I haven't paid any fees to USCIS yet, no point in paying so far ahead anyways. If the numbers progress as they did for DV2007. all numbers for asia should(hopefully :D ) be current around aug 2008. that will leave me exactly 2 months to get approved for GC. I know AOS takes a lot of time but a lot also depends on local USCIS office and I guess writing letters to senators and stuff can also help speed off process at times. Anyways, I recently married my longtime girlfriend but she's studying in UK. I know I qualify for AOS but now that I am married I am not sure how that changes things, I mean my wife has B2 visa and she's been here few times before, but I dunno if she can come along with me for interview here in USCIS should I keep the AOS option. Did anyone have had similar experience, of doing AOS. I guess doing CP would make things easier in that regards, as we can both go back to our country but I am not sure if I want to take that risk, I am planning to apply H1 next april thru my employer and in case my GC gets denied in CP process, I dunno if that would jeapordize my H1 status, assming it gets approved by then. What do you guys suggest, what's the best option for me?

no

Both of you should do CP.

H1 is a dual intent visa. Applying for GC will not hurt your chances of getting it.

I don't mean to be a killjoy, but it is possible (probable) that the available visas will be exhausted before your number comes up. You shouldn't give up hope, but you should also steel yourself for disappointment (prepare for the worst, hope for the best). Good luck to all.

Ok I have decided to switch to CP processing from AOS, I guess I will have re-submit forms for my wife. Does it matter at all if my wife doesn't change her last name in her passport and instead we use her maiden name only in the Gc application?
