Changing from AOS to Consular Processing

Due to a high case number Im considering changing from AOS to CP. Two questions

1. What is the proper process? Do I just email KCC? Do I have to now send the DSP230?

2. Has anyone done it this year? How long did it take? Did you have any problems?

OK. Now you are thinking what I was thinking one month back.
I am from Nepal. I don't have too high case number, but due to high success rate of Nepal, I had to change my thought.
I have paid the DV fee already $660 for myself and my wife. We have also done the medicals.
So a lot of investment already made. But I had to change to CP because of long AOS process and high success rate of Nepal.

Now coming to the point:

1. You first need to send the updated DSP-122 stating the US Embassy that you will be doing CP.
2. You need to send the DS230 (for yourself and your wife two separate forms) if you have not send before.

You can send these forms via email to kccdv@state.gov or kccdv230@state.gov
You have to put the pp size photo on the top left corner of the first page of DS230 and scan the document once everything has been filled out. This was the instruction from the KCC representative.

Once you send the forms, it may take several weeks. This is what they said. I did make an inquiry few weeks back and they said my forms were received but pending Embassy review. This is a normal reply from them.

I think within one month, they can change it from AOS to CP. I know, one person had changed from AOS to CP in one month in the past.

Strike all that - you are switching the different way to me.

Yes you will need 230 forms as well as corrected 122 form. Best to include a covering letter explaining that you wish to switch also. Because this will be the first time KCC hear about your family - best to send by mail or courier so you can include original photos for them.

The processing will take about 4 weeks - and that should be in plenty of time for your current notification.

You don't pay at this time, but I think the fees you have already paid will be lost - and you will have to pay that again at the embassy.
 
Ummmmm I just had a thought that might complicate matters.....

I am on my OPT and my grace period ends 1 August. If my interview is scheduled for say 5 September- won't the period between 1 August and when I fly back for CP processing be a period of overstay????!!! Any ideas what I can do about that??

The benefit of AOS was that once I filed (which if Im current September would be after the VB in July) I fall into a limbo status until my case is processed- i.e. no overstay even if my OPT grace period expires in the interim...

Personally I would just leave at the end of the OPT. You might get scheduled for an August interview, or it could be September, but you would know the dates either in June or mid July. So, when 1st August comes around you know whether you are leaving to do a CP interview or whether you are leaving until you get some other visa type. Either way, you won't want an overstay on your records. The time at home before your interview will allow you to do the medical etc and perhaps get final things done before you return to the US as a LPR.
 
Ugh, I know that's the safest course, but I have a little dog here. The thought of leaving her in boarding or with someone I dont know very well for potentially 2 months is a bit distressing. I guess I will know come June 10th or so. Praying Im current no later than August..

I think you will need to make arrangements about your dog one way or another. Your OPT was going to run out anyway, so the only change is you mentally adjusting to the fact that your remission to stay ran out at that time. However, as you say, fingers crossed for an August date for you!
 
I think you'll need to make your decision a lot earlier. If you wait until the visa bulletin showing you're current is released, you'll not benefit much from switching to cp. It'll take KCC some time to process your request to switch to CP before they can schedule your interview.

And I'm sure you're aware that you will not be able to use the $330 you've already paid if you switch to CP.

Right - so your forms will be processed by the end of April roughly - so you should be in plenty of time to be scheduled with the August cases, which will happen early/mid June.
