Changing employer..

My RD for I-485 is 1/17/2002.
I don't have EAD, because it was lost in mail and I never cared to apply for it again. My H1B is getting expired on Nov.20. My current employer filed is in the process of filing for H1B extension.

Can I change my employer with out having any problems to GC processing? Can my I-140 or I-485 be revoked at this stage by my current employer? Is it possible?

I really appreciate your help.

you didn't mention whether I-140 is approved or not. I assume it is already approved. after 6 months you can change jobs. Your old employer can't do any thing about it.

Your H1B is expiring on Nov 20th. I would say ask your new company to file H1B premium processing and find out how much time it is taking.

If you are going to get reciept number before nov 20th you are fine to work in US (That shouldn't be a problem)

As a backup process you can also apply EAD cards (Right now they are taking only 1-2 months time). I got it approved in a month time.

Being a Jan'02 case, your approval is around the corner :) . So why do you want to change your employer at this stage ? I strongly suggest that stick on to the current employer till you get your approval. This will guarantee you GC and you don't need to worry about AC21 and all that crap.

dsatish is right about it.

Don't want to scare you, but there are some people waiting with Oct and Nov rd.

If your current employer is good and not troubling you. Just like dsatish told stick with him.

If job satisfaction and money are more with new client, don't hesitate to say good buy to old employer.

You are from NJ. Even your case get transfered to Newark. Still you are fine.

Thank you guys for your valuable suggestions. The only reason I want to change my employer is that I have some problems with my current manager. I can't handle her or her butt kissers any more. The weird thing is, she works from India. She doesn't know any thing about me or what I am capable of or incapable of. We had only one tele conference call in 2 years. Can you beleive it, she is my f***ing manager.
